Information from rental and leasing applicants

If you apply to rent or lease a residence from us, or through a property manager or leasing agent acting on our behalf, we (or our screening providers) may collect additional information necessary to evaluate your application, which may include your date of birth, Social Security or government identification number, income and employment information, rental history, and the results of credit, background, and eligibility screening. We use this information solely to evaluate your application, administer any resulting tenancy, and comply with applicable housing, lending, and consumer-reporting laws. Background and credit screening is conducted in accordance with the federal Fair Credit Reporting Act and applicable state law, and is subject to the separate disclosures and authorizations provided to you at the time of application.

Information from public and third-party sources

We may also obtain information from publicly available sources and third-party data providers, including county assessor and recorder records, property databases, and similar public sources. This information may include property ownership details and the names, mailing addresses, and contact information of property owners, which we use to evaluate and pursue potential acquisitions.

Information collected automatically (Usage Data)

When you use our Website, we automatically collect certain information, which may include your device's IP address, browser type and version, the pages you visit, the date and time of your visit, time spent on pages, unique device identifiers, and other diagnostic data. When you access the Website through a mobile device, we may also collect your device type, mobile device ID, mobile operating system, and mobile browser type.

  • With advertising partners, by disclosing online identifiers and internet activity to advertising platforms to deliver and measure advertising, as described in the "Your California Privacy Rights" section below (you may opt out of this sharing);

  • With our affiliates, who are required to honor this Privacy Policy;

  • In connection with a business transfer, such as a merger, financing, acquisition, or sale of assets; and

  • With your consent, or as otherwise required by law or to respond to lawful requests by public authorities.

We do not sell your personal information for money.

Data Retention

We retain your personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, or as required by law — for example, to comply with legal obligations, resolve disputes, enforce our agreements, administer a tenancy, or retain records connected to a completed transaction or tax, housing, and recordkeeping requirements.

Your California Privacy Rights

This section applies to California residents and is provided under the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA").

Categories of personal information we collect. In the preceding 12 months we may have collected: identifiers (name, postal address, email address, telephone number); commercial information (records of property you own or have inquired about, and your interactions with our marketing); characteristics protected under law and information collected in connection with rental applications, where applicable; sensitive personal information (such as a Social Security or government identification number provided with a rental application); internet or network activity (browsing and interaction data, including through cookies and advertising technologies); geolocation data; and inferences drawn from the above. We collect this from you directly, from public records and property data, from third-party data and screening providers, and automatically through cookies and similar technologies.

How we use it. To evaluate rental applications and administer tenancies; to identify and contact owners of multifamily and mixed-use properties regarding the potential acquisition of those properties; and to deliver and measure advertising.

Sale or sharing of personal information. We do not sell your personal information for money. We use third-party advertising and analytics technologies (such as advertising pixels and cookies) that may disclose online identifiers and internet activity to advertising platforms in order to deliver targeted advertising to you across other websites. Under the CCPA, this disclosure may be considered "sharing" for cross-context behavioral advertising. We do not knowingly sell or share the personal information of consumers under 16 years of age. You have the right to opt out of this sharing, as described below.

Sensitive personal information. Where we collect sensitive personal information (such as a Social Security or government identification number) in connection with a rental application, we use it only for the purposes permitted under the CCPA, including to provide the services you requested, evaluate your application, and comply with law. We do not use sensitive personal information to infer characteristics about you.

Your rights. You have the right to: know and access the personal information we have collected about you; delete it, subject to legal exceptions; correct inaccurate information; opt out of the sale or sharing of your personal information; limit the use of sensitive personal information; and not be discriminated against for exercising these rights.

How to submit a request. Email info@LexingtonRealtyCapital.com with the subject line "California Privacy Request," or call 646-694-0321. We will confirm receipt within 10 business days and respond to verifiable requests within 45 days (extendable once by an additional 45 days with notice). We may need to verify your identity and will not require more information than necessary to do so. You may use an authorized agent to submit a request on your behalf. Where we offer browser-based opt-out tools or a "Do Not Sell or Share My Personal Information" link, you may also use those to opt out.

Retention. We retain each category of personal information only as long as reasonably necessary for the purposes described in this policy, or as required by law.

Other State Privacy Rights

If you are a resident of another U.S. state with applicable privacy laws (such as New York or Pennsylvania), you may have rights regarding your personal information, including rights of access, correction, and deletion, subject to that state's law.
